2nd Circ. Sides With Seinfeld In Cookbook Saga

Law360, New York (April 28, 2010, 1:43 PM EDT) -- Cookbook author Jessica Seinfeld — wife of comedian Jerry Seinfeld — is off the hook for trademark and copyright infringement following a federal appeals court's affirmation of a lower court decision that the idea of tricking kids into eating healthy foods can't be copyrighted.

Any similarities between cookbooks by Seinfeld and plaintiff Missy Chase Lapine arise naturally from the works' themes, not from author creativity, the U.S. Court of Appeals for the Second Circuit ruled Wednesday in an eight-page summary order.
