ERISA Action Against Baxter Tossed Out

Law360, New York (May 5, 2010, 6:09 PM EDT) -- A federal court has thrown out an Employee Retirement Income Security Act class action accusing health care company Baxter International Inc. of letting retirement plan participants invest in Baxter stock despite knowing it was inflated.

Judge Joan B. Gottschall of the U.S. District Court for the Northern District of Illinois on Monday granted Baxter’s bid for summary judgment and denied the lead plaintiff’s bid for partial summary judgment.
