Domino's FLSA Class Wins Conditional Cert.

Law360, New York (June 22, 2010, 6:10 PM EDT) -- A group of former Domino's Pizza LLC delivery drivers has won conditional collective action certification in a suit accusing the pizza chain of effectively paying less than minimum wage by forcing drivers to cover their own gas expenses.

The plaintiffs met the relatively light burden of presenting some logical basis to support their claim that they all suffered from a single policy in violation of the Fair Labor Standards Act, Judge Donovan W. Frank of the U.S. District Court for the District of Minnesota ruled Monday....
