Classes Certified In Smith & Wollensky FLSA Tip Suit

Law360, New York (July 27, 2010, 7:57 PM EDT) -- A federal judge has granted class certification to tipped workers from The Smith & Wollensky Restaurant Group Inc. who allege the steakhouse chain illegally required them to pool their tips and failed to pay required overtime and minimum wages.

Judge Ruben Castillo of the U.S. District Court for the Northern District of Illinois certified Monday a class of Smith & Wollensky employees who had earned subminimum, “tip-credit” wages and a separate class of tipped employees alleging they hadn't received sufficient overtime wages.
