Court Rules Tribal Casinos Fall Under Labor Laws

Law360, New York (February 12, 2007, 12:00 AM EST) -- In a blow to Indian tribes’ sovereignty across the United States, an appeals court has found that an affluent Southern California tribe is subject to federal labor law.

A three-judge panel of the U.S. Court of Appeals for the District of Columbia Circuit disagreed Friday with the tribe’s argument that as a sovereign government it is exempt from those federal laws, which could set the stage for more labor regulations and union representation at U.S. tribes.
