Bayer Wins Toss Of Third-Party Payors Suit In Yaz MDL

Law360, New York (August 6, 2010, 11:58 AM EDT) -- In the latest ruling in multidistrct litigation over Bayer Healthcare Pharmaceuticals Inc.'s Yaz contraceptive, a federal judge has thrown out a class action brought by third-party payors who alleged they paid too much for too many Yaz prescriptions because Bayer fraudulently marketed the drug.

Judge David R. Herndon of the U.S. District Court for the Southern District of Illinois granted Bayer's motion to dismiss Thursday, saying the plaintiffs failed establish a connection between Bayer's marketing and the alleged damages.
