Law360 (August 27, 2010, 5:48 PM EDT) -- A federal appeals court has affirmed a ruling that killed a collective action alleging accounting firm Callaway Partners LLC misclassified its accountants as overtime exempt.
Callaway, which has since been acquired by Huron Consulting Group Inc., properly classified accountants as exempt from the overtime provisions of the FLSA, the U.S. Court of Appeals for the Eleventh Circuit affirmed Thursday.
“The class of plaintiffs in this lawsuit are highly educated accountants and certified public accountants who, during their employment with Callaway, often made more than $100,000 a year," the opinion stated. "Consequently, plaintiffs fall under the overtime exemption.”
