Plaintiff Denied Mandamus In Google Android IP Spat

Law360, New York (September 10, 2010, 11:27 AM EDT) -- A software business owner has lost his bid for a writ of mandamus in his suit alleging Google Inc.'s Android mobile device operating system infringes his trademarks for the name Android with respect to software.

A three-judge panel in the U.S. Court of Appeals for the Seventh Circuit on Wednesday struck down Eric Specht's appeal over whether he could add AT&T Mobility LLC to the suit as a defendant and whether the judge overseeing the case, whose wife works for AT&T, could adjudicate the motion....
