Fidelity Sued Over Hurricane Ike Coverage

Law360, New York (September 14, 2010, 4:15 PM EDT) -- Two Overton, Texas, residents have launched a putative class action claiming that Fidelity National Property and Casualty Insurance Co. owes them flood insurance coverage for damages sustained below the first elevated floor of their homes during Hurricane Ike.

Jackie and Goldie Grigsby allege that the insurer breached these insurance contracts by unlawfully rescinding its pledge made in written declarations to provide coverage for damages to their home's contents located “at the basement enclosure and above,” according to the complaint filed Monday in the U.S. District Court...
