Safety-Kleen Wins Decertification Bid In OT Case

Law360, New York (September 22, 2010, 1:14 PM EDT) -- Citing difficulty applying certain exemptions, a federal judge has granted Safety-Kleen Systems Inc.'s bid to decertify a class of 304 customer service representatives who claim they were not given proper compensation for overtime hours worked.

Judge Phyllis J. Hamilton of the U.S. District Court for the Northern District of California on Monday approved a motion from the defendant to torpedo the class, ruling that the plaintiffs' varied job duties made it too difficult to uniformly sort out when overtime exemptions applied to each plaintiff.
