Comcast Wins Exit From Technicians' FLSA Suit

Law360, New York (September 29, 2010, 4:41 PM EDT) -- A federal judge has ruled Comcast Corp. cannot be considered a joint employer of cable technicians who worked for third-party installation companies, dealing a blow to a collective action seeking to hold Comcast liable for Fair Labor Standards Act wage violations.

Judge J. Frederick Motz of the U.S. District Court for the District of Maryland granted Comcast's motion for summary judgment on Tuesday. The plaintiffs argued Comcast and the installation companies, which contracted with Comcast, failed to pay them overtime as required by the FLSA....
