Encore's Competition Claim Against Southwire Lives On

Law360, New York (October 1, 2010, 2:49 PM EDT) -- Electrical cable and wire maker Southwire Inc. has lost its bid to toss Encore Wire Corp.'s counterclaim for unfair competition under California law in a suit accusing Encore of patent and trademark infringement.

Judge Leonard Davis denied Southwire's motion to ditch the claim in the U.S. District Court for the Eastern District of Texas on Thursday, shooting down the argument that Encore's assertion was time-barred.
