Small Biz Agency Can Keep Records Private: 9th Circ.

Law360, New York (October 18, 2010, 5:48 PM EDT) -- The U.S. Small Business Administration does not have to turn over cell phone records to an advocacy group that is trying to prove the agency conspires to steer small business contracts to large companies, according to a federal appeals court.

The U.S. Court of Appeals for the Ninth Circuit affirmed on Friday a lower court's ruling that the Freedom of Information Act does not compel agencies to overturn all records controlled by third parties, only those controlled as part of records-management contracts.
