Judge Greenlights DADT Ban Amid Appeal

Law360, New York (October 19, 2010, 8:16 PM EDT) -- A federal judge has rejected the U.S. government's request to stay pending appeal a recent injunction banning the controversial “don't ask, don't tell” policy that prohibits gays and lesbians from openly serving in the military.

Judge Virginia Phillips of the U.S. District Court for the Central District of California issued her denial late Tuesday, finding that the government had not met the burden necessary to warrant a stay of the injunction while an appeal is pursued with the U.S. Court of Appeals for the Ninth Circuit....
