2nd Circ. Upholds Toss Of Kazakhstan Oil Profits Suit

Law360, New York (October 21, 2010, 7:23 PM EDT) -- A federal appeals court has rejected Pricaspian Development Corp.'s challenge to the dismissal of its second attempt to collect profits from France-based petroleum giant Total SA as part of an agreement related to oil exploration in Kazakhstan.

A three-judge panel in the U.S. Court of Appeals for the Second Circuit affirmed the Southern District of New York's dismissal of the case on Thursday, letting stand the lower court's November determination that the instant action is barred by a prior judgment in Colorado that dismissed similar claims...
