Ex-Pfizer Exec Takes Genotropin Suit To 1st Circ.

Law360, New York (October 29, 2010, 1:52 PM EDT) -- A former Pfizer Inc. vice president is appealing the dismissal of a qui tam suit that alleges the drugmaker — which pled guilty in a related criminal probe — and affiliate Pharmacia Corp. paid kickbacks to physicians and marketed growth hormone deficiency medication Genotropin for off-label uses.

Relator Peter Rost filed a notice of appeal in the U.S. Court of Appeals for the First Circuit on Thursday, challenging a district court’s decision in September to grant the drug companies’ summary judgment motion.
