Calif. Court Affirms Denial Of Chipotle Staff Class Cert.

Law360, New York (October 29, 2010, 5:17 PM EDT) -- A California appeals court has affirmed the denial of class certification for a Chipotle Mexican Grill Inc. worker alleging the chain violated state law because its employees missed meal breaks, ruling that employers are not obligated to ensure workers take breaks.

In an opinion published Thursday, the Court of Appeal of the State of California, Second Appellate District, Division Eight affirmed a lower court’s ruling denying Rogelio Hernandez’s bid for class certification in the case against Chipotle.
