US Wins Dismissal Of NJ Developer's Enviro Claim

Law360, New York (November 10, 2010, 1:43 PM EST) -- A federal judge has tossed a New Jersey real estate developer's environmental claim against the U.S. government over contamination at a former arsenal that was turned into a housing and shopping development.

Judge Lynn J. Bush of the U.S. Court of Federal Claims on Tuesday threw out U.S. Home Corp.'s breach of implied contract claim against the government, saying it made no legally binding promises when it turned the land over that it was clean.
