Flonase Purchasers Win Class Cert. In Suit Against GSK

Law360, New York (November 15, 2010, 1:34 PM EST) -- A federal judge has granted class certification to direct purchasers of allergy drug Flonase in an antitrust suit against GlaxoSmithKline PLC alleging that the company filed “baseless” petitions with the U.S. Food and Drug Administration to delay the sale of a generic.

GSK did not oppose wholesale drug purchaser American Sales Co.'s motion for class certification, and Judge Anita B. Brody of the U.S. District Court for the Eastern District of Pennsylvania saw no reason not to grant it, according to an order issued Friday....
