IT Workers Win Cert. In Overtime Suit Against HP Unit

Law360 (December 16, 2010, 6:30 PM EST) -- A federal judge has granted conditional certification to six classes of employees at information technology outsourcing company Electronic Data Systems Corp., which stands accused of failing to pay overtime in violation of the Fair Labor Standards Act.

Judge Richard J. Holwell of the U.S. District Court for the Southern District of New York filed the order Tuesday. EDS, which has since been acquired by Hewlett-Packard, says the classes could number as high as 19,500 workers.
