$76M Mylan Suit Remanded Over Jurisdictional Issues

Law360, New York (January 18, 2011, 5:05 PM EST) -- The D.C. Circuit has left intact a $76 million verdict in an antitrust lawsuit against Mylan Laboratories Inc. but sent the case back to the district court, finding that certain plaintiffs did not have jurisdiction to bring the case.

The plaintiffs mistakenly invoked diversity jurisdiction in the case because at least one of them resided in the same state as a defendant, according to a ruling handed down Tuesday in the U.S. Court of Appeals for the District of Columbia Circuit.
