Snapple Seeks To Kill Immunity Claims Class Action

Law360, New York (January 21, 2011, 3:55 PM EST) -- Dr. Pepper Snapple Group Inc. has asked a federal court to dismiss a putative class action claiming the company lied about the health benefits of its acai mixed berry red tea, saying the plaintiffs cannot prove its health claims are false.

Snapple’s claims in advertisements and on its website that its acai tea increases the body’s immunity may be unsubstantiated, but that only makes allegations of falsity possible, not plausible, the beverage giant said in a motion to dismiss filed Thursday in the U.S. District Court...
