Calif. Court Affirms Retrial In Sprint Fee Actions

Law360, New York (March 4, 2011, 7:07 PM EST) -- A California appeals court affirmed a lower court's decision Thursday in three linked class actions over Sprint Nextel Corp.'s early termination fees on cell phone contracts, saying the trial court was right to order a new trial on damages.

The California Court of Appeals, First Appellate Division, said the lower court correctly determined that the jury's verdict on damages was inconsistent with the law and the court's instructions, and had also correctly rejected Sprint's arguments that federal law governing cell phone rates meant it could not...
