UnitedHealth Hit With ERISA Class Action

Law360, New York (March 4, 2011, 2:49 PM EST) -- Two participants in an employee health insurance plan administered by UnitedHealth Group Inc. filed a class action Wednesday in a New Jersey federal court, alleging the company improperly calculated benefits for insureds who also participated in Medicare.

The suit, filed in the the U.S. District Court for the District of New Jersey, claims that United violates the Employee Retirement Income Security Act by calculating benefits payable under its plans by estimating how much Medicare would pay, even when patients have actually made filings with Medicare....
