Best Buy Deflects Copyright Infringement Claims

Law360, New York (April 23, 2007, 12:00 AM EDT) -- A federal judge has dismissed a handful of claims against Best Buy Co. Inc. alleging copyright infringement of movie trailers, though the case will be allowed to proceed on breach of implied contract grounds.

In a 48-page order issued Wednesday, Judge Phyllis J. Hamilton of the U.S. District Court for the Northern District of California said the plaintiffs in two cases had failed to establish any substantial similarity of protected expression for their respective movie trailers, which encouraged moviegoers to shut off their cell phones....
