General Mills Seeks To Ax Suit Over Yoplait Ad Claims

Law360, New York (March 21, 2011, 8:37 PM EDT) -- General Mills Inc. said Friday that a class action claiming its Yoplait USA Inc. division exaggerated the health benefits of its yogurt products should be tossed because the claims were not actionable under the New Jersey Consumer Fraud Act.

The company filed a motion for summary judgment in the U.S. District Court for the District of New Jersey describing the plaintiffs' claims as nonactionable puffery.
