Lockheed Can't Shake Subcontractor's Pricing Suit

Law360, New York (April 8, 2011, 1:48 PM EDT) -- A Texas federal judge on Wednesday rejected Lockheed Martin Corp.’s attempt to toss a claim in a subcontractor’s suit alleging the defense giant refused to fairly negotiate a $9 million price adjustment on a subcontract to build fighter jet parts.

Judge Barbara Lynn of the U.S. District Court for the Northern District of Texas denied Lockheed’s motion to dismiss Triumph Aerostructures LLC-Vought Aircraft Division’s quantum meruit and unjust enrichment claim, ruling that it would be premature to drop the claim before discovery.
