AstraZeneca, P&G Dodge Prilosec OTC Antitrust Suit

Law360, New York (April 18, 2011, 3:27 PM EDT) -- A New York federal judge on Thursday tossed out American Sales Co. Inc.'s proposed class action alleging AstraZeneca AB and The Procter & Gamble Co. initiated sham patent suits in order to perpetuate an unlawful monopoly over Prilosec OTC.

U.S. District Judge P. Kevin Castel ruled the complaint did not plausibly allege a relevant product market, but left room for American Sales to amend its complaint to adequately allege all of the elements of a monopolization claim.
