NY Court Curbs Diesel Emission Regs For Contractors

Law360, New York (April 22, 2011, 8:27 PM EDT) -- The Appellate Division of the New York Supreme Court on Thursday reined in the state's rules for diesel emissions from vehicles used by contractors, finding their scope did not extend to subcontractors.

The appellate court found that the state legislature clearly intended for the New York Department of Environmental Conservation's rules to only cover vehicles that are used by contractors with a direct contract with a state agency when it passed its 2006 law requiring state vehicles to switch to low-sulfur fuel and use retrofit technology...
