Ernst & Young OT Action Should Stay In NY: Judge

Law360, New York (April 25, 2011, 5:14 PM EDT) -- A magistrate judge recommended Monday against allowing Ernst & Young LLP to merge a New York class action accusing the auditing firm of denying accountants overtime with three similar suits pending in California.

E&Y failed to show that transferring the case from the Southern District of New York to the Northern District of California would be in the interest of justice and convenience, U.S. Magistrate Judge Michael Dolinger said in a report.
