Formosa Plastics Escapes Defective Pipe FCA Suit

Law360, New York (May 11, 2011, 2:01 PM EDT) -- A California federal judge dismissed a plastics maker Monday from a suit over purportedly defective PVC piping sold to the government, saying the whistleblower had not factually linked it to allegedly false claims submitted by an ex-subsidiary for which he worked.

Judge George Wu dismissed most of the claims against Formosa with prejudice, but allowed plaintiff John Hendrix a chance to amend his claims of inadvertent submissions of false claims under the state laws of California, Massachusetts, Nevada, New Mexico and Tennessee. Judge Wu also denied...
