Nutella False Marketing Action To Remain In Calif.

Law360, New York (May 11, 2011, 7:14 PM EDT) -- A California federal judge on Wednesday denied Nutella maker Ferrero USA Inc.’s bid to transfer to New Jersey federal court a putative consumer class action claiming the company falsely marketed its popular spread as healthy for children.

U.S. District Judge Marilyn Huff ruled that the lawsuit would remain in the Southern District of California, saying all the relevant factors governing case transfer weighed against moving the case to New Jersey, or were at best neutral.
