3rd Party Has Rights To Fraudster's Money: 7th Circ.

Law360, New York (May 12, 2011, 7:04 PM EDT) -- The Seventh Circuit on Thursday ruled that a U.S. writ of garnishment on a Medicare and Medicaid fraudster's interest in a Georgia business venture could not stamp out third-party interests recognized by state law.

In a published opinion, a three-judge panel vacated a district court judgment against investors seeking $175,000 based on their stake in a creditor of 410 Montgomery LLC, which built housing in Georgia and was liquidated after the government exercised its garnishment writ against Peter Rogan's interest in the firm as an equity...
