Toyota Alleges MDL Abuse With Calif. State Claims

Law360, Los Angeles (May 16, 2011, 11:08 PM EDT) -- Toyota Motor Corp. told a California federal judge Monday that a motion by plaintiffs in multidistrict litigation over sudden acceleration defects in its cars was a tactic aimed at abusing the MDL process to wrongfully deprive the automaker of defenses.

The hearing dealt with a motion by a group of plaintiffs who asked the federal court to apply California state law to their claims. U.S. District Judge James V. Selna’s decision on the motion could have far-reaching impact on how the massive multidistrict litigation plays out...
