Ex-Dick's Atty Wants Prosecutor Off Kickbacks Case

Law360, New York (June 16, 2011, 6:30 PM EDT) -- A former lawyer for Dick’s Sporting Goods Inc. asked a New York federal court Thursday to disqualify the government attorney prosecuting charges that he lied to investigators and took part in a multimillion-dollar kickback scheme.

Benjamin Viloski told the court that assistant U.S. attorney Steven D. Clymer should not be allowed to pursue the charge that Viloski made intentionally false statements during a May 2009 interview with Clymer and FBI agents, as the government lawyer cannot be permitted to act "as both prosecutor and witness."...
