NBC's 'Earl' Didn’t Infringe Screenplay: 9th Circ.

Law360, San Diego (June 16, 2011, 8:54 PM EDT) -- The Ninth Circuit on Thursday upheld the dismissal of a writer’s copyright infringement suit alleging National Broadcasting Co. and Twentieth Century Fox Film Corp. ripped off his screenplay when they created the TV show “My Name is Earl.”

A three-judge panel determined that a California district court correctly granted summary judgment to the defendants, finding that Mark Gable failed to raise a genuine issue of material fact over whether the TV show and his “Karma!” screenplay were substantially similar in protected expression.
