Nothing Brewing For Starbucks Baristas In Tip Action

Law360, New York (July 11, 2011, 9:39 PM EDT) -- A New York federal judge on Monday tossed a class action suit brought by Starbucks Corp. assistant managers and trainees who said the coffee chain denied them their share of tips from the pooled tip jar.

U.S. District Judge Laura Taylor Swain granted Starbucks' motion for summary judgment, saying the New York labor law in question — section 196-d, which prohibits employers from keeping tips meant for employees — does not grant any employee a right to participate in tip pools
