Fifth Third Bank Seeks Sanctions In Ch. 11 Pizza Fight

Law360, New York (August 15, 2011, 7:32 PM EDT) -- Fifth Third Bank, lender to the bankrupt Chicago pizzeria chain Giordano's Enterprises Inc., on Monday asked an Illinois bankruptcy court to sanction the restaurant's owners for trying to block the bank from bidding in any potential asset sale.

In its motion for monetary sanctions, the bank claims that the restaurant's owners — members of the Apostolou family — are in contempt of court for allegedly violating a May bankruptcy court order and the automatic stay with their Aug. 3 lawsuit filed in state court.
