Pfizer Seeks To Toss Celebrex, Bextra Cases

Law360, New York (June 11, 2007, 12:00 AM EDT) -- Pharmaceuticals giant Pfizer Inc. has asked a judge to dismiss complaints filed in multidistrict litigation over anti-inflammatory painkillers Celebrex and Bextra on the grounds that the plaintiffs didn't claim that deceptive advertising drove them to buy the drugs.

“Your honor, each named plaintiff must allege that he/she/it saw or heard deceptive advertising and purchased Celebrex or Bextra as a result of having seen or heard the deceptive statements,” Pfizer said in a letter to Judge Charles Breyer, filed on Sunday in the U.S. District Court for...
