3rd Circ. Reverses Stance On Verizon Rate Hike Dispute

Law360, New York (August 24, 2011, 5:39 PM EDT) -- After the U.S. Supreme Court struck down its earlier ruling, the Third Circuit decided Wednesday that Verizon Wireless could force two consumers to individually arbitrate a contract dispute over allegedly unlawful rate increases because they signed class arbitration waivers.

Verizon customers Keith Litman and Robert Wachtel accuse the communications giant of imposing bogus "administrative" monthly charges even though the company was contractually obligated to provide cellphone service at a fixed price.
