Dr. J Didn't Steal Dr Pepper Ad Idea, Judge Rules

Law360, New York (August 29, 2011, 2:33 PM EDT) -- Ruling that there was no basis for the claims, a Nevada federal judge on Friday threw out a suit by a man who alleged that basketball legend Julius "Dr. J" Erving stole his idea to have Erving promote the soft drink Dr Pepper.

U.S. District Judge Roger L. Hunt granted Erving's motion for summary judgment, finding it was a coincidence that the NBA Hall of Famer starred in a Dr Pepper ad after plaintiff George Burns suggested the idea to him.
