Hotel Owner Aims To Thwart Marriott With Ch. 11

Law360, New York (September 1, 2011, 2:22 PM EDT) -- The owner of a $250 million luxury hotel in Honolulu filed for Chapter 11 bankruptcy protection Wednesday in a bold move aimed at terminating a management agreement with Marriott International Inc., which is battling in New York for control of the disputed property.

Earlier in the day, a New York court granted Marriott a temporary restraining order allowing it to resume its operation of the Modern Honolulu. The owner, M Waikiki LLC, fired back with the bankruptcy petition in an effort to block the court's order....
