BofA Loan Officers Win Class Cert. In OT Action

Law360, New York (September 2, 2011, 8:52 PM EDT) -- An Illinois federal judge hit Bank of America Corp. with a double blow Wednesday, certifying a class of mortgage loan officers and refusing to dismiss one lead plaintiff's claims in an action over overtime compensation.

In granting certification, U.S. Magistrate Judge Blanche Manning rejected the financial giant's arguments against potential class members’ individual entitlement to exemptions, saying she found them "insufficient to defeat conditional certification."

The loan officers brought the class action against Bank of America in August 2010, alleging the bank and its co-defendants violated the Fair Labor Standards...
