DirecTV Fee Claims Head To Arbitration After Concepcion

Law360, New York (September 9, 2011, 3:13 PM EDT) -- Citing the U.S. Supreme Court’s Concepcion decision, a California federal judge on Tuesday ordered certain consumers in a putative class to arbitrate claims over DirecTV Inc.’s early cancellation fees, but denied the company’s bid to arbitrate injunctive relief claims under two California consumer protection laws.

Ruling on DirecTV's motion to compel arbitration, U.S. District Judge Andrew J. Guilford said particular injunctive relief claims aren't subject to arbitration under California law. They include claims under the state Consumer Legal Remedy Act and the California Unfair Competition Law...
