Rolling Stone, Us Publisher Sued Over Spam Texts

Law360, New York (September 21, 2011, 1:25 PM EDT) -- Consumers hit Rolling Stone and Us Weekly publisher Wenner Media LLC with a putative class action Tuesday in California federal court alleging it transmitted unsolicited text messages that promised, but never sent, gift cards to those who acted on the texts.

In a bid to increase paid subscriptions to its magazines, Wenner uses outside telemarketing agents to send the text messages to consumers' cellphones offering the gift cards, according to the complaint filed by named plaintiffs Jasmine Hubbard and Marvel Mills.
