US Violated Islamic Charity's Rights: 9th Circ.

Law360, New York (September 23, 2011, 7:37 PM EDT) -- The Ninth Circuit ruled Friday that the U.S. Department of the Treasury had violated the constitutional rights of an Islamic charity designated as a terrorist organization in a suit challenging the government's failure to obtain a warrant before freezing their assets.

The appeals court found that the Treasury Department had infringed Al Haramain Islamic Foundation Inc.'s Fifth Amendment right to due process and its Fourth Amendment right to freedom from reasonable seizures.
