Cox Can't Pull Plug On Cable Box Tying Action

Law360, New York (September 27, 2011, 5:03 PM EDT) -- An Oklahoma federal judge on Monday rejected Cox Communications Inc.’s bid to dismiss a customer’s putative class action in a larger multidistrict litigation, saying the customer had sufficiently demonstrated that Cox may have illegally tied the purchase of set-top cable boxes to customers’ cable subscriptions.

U.S. District Judge Robin J. Cauthron ruled that the plaintiff's amended complaint had corrected the errors of the initial action by directly alleging that Cox engaged in the practice of charging customers for equipment without disclosing the nature of the equipment...
