Law360, San Diego (September 29, 2011, 6:33 PM EDT) -- The Ninth Circuit on Thursday held that a decision striking down the U.S. military’s “don’t ask, don’t tell” rule had to be vacated as moot now that the ban on openly gay service members has been officially repealed.
