Music Download Appeal Falls On Deaf Ears In High Court

Law360, New York (October 3, 2011, 3:05 PM EDT) -- The U.S. Supreme Court on Monday let stand a lower court’s ruling in a dispute between musicians and several Internet companies including Yahoo Inc. that a music download does not constitute a public performance, limiting the amount of royalties artists can collect from online music vendors.

The high court refused to review a 2010 decision by the Second Circuit that ruled music downloads are simple transfers of electronic files containing digital copies from an online server to a local hard drive, and not musical performances contemporaneously...
