Citing Dukes, Judge Nixes Class In Countrywide Bias Suit

Law360, New York (October 13, 2011, 7:10 PM EDT) -- A Kentucky federal judge on Wednesday cited the U.S. Supreme Court’s Dukes decision in refusing to certify a proposed class of Hispanic and African-American homebuyers who claim Countrywide Bank NA discriminated against them by charging them more for mortgages.

The proposed class members in the multidistrict litigation allege that Countrywide — now part of Bank of America Corp. — discriminated against them between 2005 and 2007 by charging them higher rates and fees for mortgages than they did for similarly situated nonminority borrowers.
